Defining Serious Injury According to New York Injury Laws

Differing from many other states, New York insurance law requires an injured party to satisfy one of the nine categories of “serious injury” in order to pursue a personal injury case for pain and suffering damages. They are:

  • Wrongful death
  • Traumatic brain injury (TBI)
  • Dismemberment
  • Significant disfigurement
  • Fractures
  • Loss of a fetus
  • Permanent loss of use of a body organ, member, function or system
  • Permanent consequential limitation of use of a body organ or member
  • Significant limitation of use of a body function or system
  • A medically determined injury or impairment of a non-permanent nature which prevents the injured person from performing substantially all of the material acts which constitute such person’s usual and customary daily activities for not less than ninety days during the one hundred eighty days immediately following the occurrence of the injury or impairment

Our New York car accident lawyers understand these classifications can be confusing. There are thousands of legal decisions interpreting the meaning of the law. At Kahn Gordon Timko & Rodriques P.C. an attorney will discuss your injuries and circumstances to determine whether you have a strong case.
